Agreement to Terms

By accessing or using BouncBack ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users of the Service, including business owners, employees, and any other individuals who access or use the Service on behalf of a business.

Service Description

BouncBack is an AI-powered missed call text-back service designed for small businesses. When you miss a call, our service automatically sends a text message to the caller on your behalf, engages them in conversation using AI, and captures lead information for your follow-up.

Key features include:

  • Automated text responses to missed calls within seconds
  • AI-powered conversations trained on your business information
  • Lead capture and notification system
  • Analytics dashboard to track performance
  • Integration with your existing phone number

The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any feature at any time.

Pricing and Payment

BouncBack offers the following subscription plans:

All prices are in USD and billed monthly unless otherwise specified. Prices are subject to change with 30 days notice to existing subscribers.

Free Trial

New users receive a 7-day free trial. No credit card is required to start your trial. At the end of the trial, you must select a paid plan to continue using the Service.

Payment Terms

  • Payments are processed securely through our third-party payment provider
  • Subscriptions automatically renew each billing cycle unless cancelled
  • You are responsible for keeping your payment information current
  • Failed payments may result in service suspension

Acceptable Use

You agree to use BouncBack only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Send spam, unsolicited messages, or messages that violate anti-spam laws (TCPA, CAN-SPAM, etc.)
  • Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the Service to collect personal information without proper consent
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service for any purpose that competes with BouncBack
  • Resell or redistribute the Service without our written permission

Important: You are responsible for ensuring that your use of the Service complies with all applicable laws, including telecommunications regulations and consumer protection laws in your jurisdiction.

Your Responsibilities

As a BouncBack user, you are responsible for:

  • Providing accurate business information for AI training
  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Following up with leads captured by the Service
  • Ensuring your business practices comply with applicable laws
  • Honoring any commitments made by the AI on your behalf (e.g., appointment times, service availability)

Message Opt-Out

Recipients of text messages sent through BouncBack can opt out at any time by replying STOP to any message.

When a recipient opts out:

  • They will immediately stop receiving automated messages from your BouncBack number
  • You will be notified of the opt-out in your dashboard
  • The opt-out will be honored permanently unless the recipient explicitly opts back in

You agree not to contact opted-out individuals through other means to circumvent their opt-out request.

Cancellation and Refunds

How to Cancel

You may cancel your subscription at any time through your account dashboard or by contacting us at contact@bouncback.com.

Effect of Cancellation

  • Your subscription will remain active until the end of your current billing period
  • You will not be charged for subsequent billing periods
  • Your data will be retained for 30 days after cancellation, then permanently deleted
  • You can reactivate your account within 30 days without losing your data

Refund Policy

We do not offer refunds for partial months of service or unused conversations. If you believe you have been charged in error, please contact us within 30 days of the charge.

Intellectual Property

The Service, including its original content, features, and functionality, is owned by BouncBack and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any business information, content, or data you provide to the Service. By using the Service, you grant us a limited license to use this information solely to provide and improve the Service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOUNCBACK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to BouncBack in the twelve (12) months preceding the claim.

We are not liable for:

  • Messages that fail to send due to carrier issues or recipient phone settings
  • AI responses that are inaccurate or inappropriate
  • Lost business opportunities or leads
  • Service interruptions or downtime
  • Actions taken by third parties, including message recipients
  • Your failure to follow up on leads or honor commitments

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • AI responses will always be accurate or appropriate
  • The Service will meet your specific requirements
  • All messages will be successfully delivered

Indemnification

You agree to indemnify, defend, and hold harmless BouncBack and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Content you provide to the Service
  • Your business practices or dealings with customers

Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Reasons for termination may include:

  • Violation of these Terms or our Acceptable Use Policy
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Excessive complaints from message recipients
  • At our sole discretion for any reason

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive.

Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
